Math Grader AI – Terms of Service
These Terms of Service ("Terms") govern your use of Math Grader AI LLC ("Company," "we," "our," or "us") and the Math Grader AI platform (the "Services"). By using our Services, you agree to these Terms. If you do not agree, you may not use our Services.
1. Eligibility & Account Registration
- You must be 18 years or older to create an account.
- Accounts are created via Google Sign-In and require a valid email address.
- If you are using the Services on behalf of a school or district, you represent that you are authorized to enter into this agreement on their behalf.
2. Student Data & Educational Records
If you upload or submit student information, including names, tests, or scores ("Student Data"), you represent that:
- You have the legal right and/or required permissions to share such data.
- Such data is considered educational records under the Family Educational Rights and Privacy Act ("FERPA") and similar state laws.
- We act as a school official with a legitimate educational interest, processing Student Data solely for the purpose of providing our Services.
- All Student Data remains the property of the school, district, or teacher who provided it.
- In cases where a school or district has entered into an agreement with us, that entity shall be considered the primary data controller, and teachers use the Services under the direction of their institution.
3. Privacy & Compliance
We comply with:
- FERPA (Family Educational Rights and Privacy Act)
- SOPIPA (Student Online Personal Information Protection Act)
- California Education Code §49073.1
- Applicable state student data privacy laws
We will:
- Not sell or use Student Data for targeted advertising or marketing.
- Process Student Data only as directed by the school, district, or teacher.
- Delete Student Data upon request or as described in our Privacy Policy.

4. License to Use Services
We grant you a limited, non-exclusive, non-transferable license to access and use our Services solely for educational purposes and in accordance with these Terms.
5. Payment & Refunds
- Paid subscriptions are billed through Stripe.
- Refunds are only provided as required by law.
- Pricing and plans are described on our website and may change with notice.
6. Restrictions
You agree not to:
- Upload Student Data without proper authorization.
- Share account credentials or allow unauthorized access.
- Reverse-engineer, copy, or modify the Services.
- Use the Services for unlawful purposes or in violation of privacy laws.
You are solely responsible for the content and Student Data you upload to the Services.
7. Data Security
We use encryption in transit and at rest, access controls, and other industry-standard safeguards to protect Student Data and personal information.
If a data breach occurs, we will notify affected parties in accordance with our Breach Response Plan and applicable laws. Our Breach Response Plan is available upon request by schools or districts.
8. Data Retention & Deletion
- Student Data is retained for up to 6 months after the last account activity, unless otherwise directed by the school, district, or teacher.
- Upon termination or written request, we will delete Student Data in accordance with our Privacy Policy, unless retention is required by law.
9. Service Availability
We strive to maintain continuous availability but do not guarantee uninterrupted service. We may suspend or terminate Services for maintenance, security, or other lawful reasons.
We may add, modify, or discontinue features, provided that such changes do not materially reduce the core functionality of the Services without reasonable notice.
We do not guarantee specific grading outcomes, scores, or results from use of the Services.
10. Liability Limitations
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages.
- For claims involving Student Data, our total liability will not exceed the amount you paid in the preceding 12 months, except as otherwise required by law.
To the fullest extent permitted by law, Math Grader AI shall not be liable for any loss, corruption, or unavailability of data, except to the extent caused by our gross negligence or willful misconduct.
11. Indemnification
You agree to indemnify, defend, and hold harmless Math Grader AI LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) your unauthorized upload, submission, or use of Student Data;
(b) your violation of these Terms or applicable law; or
(c) your misuse of the Services.
This indemnification obligation does not apply to the extent a claim arises from Math Grader AI's gross negligence or willful misconduct.
12. Termination
We may suspend or terminate your account if you violate these Terms. Upon termination, your license to use the Services ends, and Student Data will be deleted according to Section 8.
13. Dispute Resolution
Unless otherwise specified in a district agreement, disputes will be resolved through binding arbitration rather than in court, except that you may bring eligible claims in small claims court.
14. Accessibility & Nondiscrimination
We are committed to providing Services in compliance with applicable accessibility and nondiscrimination laws, including Section 508 and the Americans with Disabilities Act (ADA).
15. Changes to These Terms
We may update these Terms periodically. Material changes will be communicated via email or platform notice. Continued use of the Services after changes constitutes acceptance of the new Terms.
